Criminal mischief involves the willful and malicious injury or damage of property. It is classified by three levels. If the damage was:
- $200 or less, it is a second-degree misdemeanor
- More than $200 and less than $1,000, it is a first-degree misdemeanor
- More than $1,000, it is a third-degree felony
There are other elements to consider as well. For example, if the damaged property is a place of worship such as a church or synagogue, and if the damage exceeds $200, it is a third-degree felony.
