Attorney Jay R. Rooth served as a panel Attorney for the Federal Bar Association, Orlando Chapter and the Bench Bar Fund of the U.S. District Court for the Middle District of Florida, participating in an in-depth discussion focused on the practical and strategic aspects of federal criminal defense practice. The program brought together experienced practitioners to provide attendees with a comprehensive, real-world perspective on navigating federal investigations and prosecutions from inception through trial and sentencing.
During the panel, Attorney Rooth addressed critical stages of federal criminal cases, emphasizing proactive advocacy and strategic decision-making. Topics included target letters and “knock and talk” encounters, highlighting the importance of early intervention and client protection during federal investigations. He discussed the value of pre-charge representation and grand jury advocacy, offering insight into how early engagement can significantly impact case outcomes. The discussion also covered detention and bond hearings, including effective arguments, evidentiary considerations, and judicial expectations in federal court. The panel provided practical guidance on motion practice under local rules, strategic use of discovery, and the procedural and cultural distinctions between Assistant United States Attorneys (AUSAs) and Assistant State Attorneys (ASAs).Additional topics included a detailed examination of Pre-Sentence Investigation Reports (PSIs), negotiation and structuring of plea agreements, application of the federal sentencing guidelines, and advocacy at sentencing hearings. The panel further explored courtroom dynamics, judicial preferences, trial strategy, and best practices for presenting cases before federal judges and juries.
